These Terms and Conditions govern access to and use of the Swim Hair LLC website, online store, content, services, and the purchase and use of the Swim Hair Splash Cap and related Swim Hair products. By accessing the website, submitting an order, or purchasing a product, you agree to these Terms and all policies incorporated into them.

Eligibility and Purchases

The online store is intended for adults who are legally able to enter into a purchase transaction. Products intended for children should be purchased, inspected, and provided to children by a parent, guardian, or other responsible adult.

Product Description and Expectations

The Swim Hair Splash Cap is a children's swim cap and wearable hair accessory with attached synthetic play hair. It is designed for recreational water activities and includes layered cap construction intended to help reduce water entering the cap. Certain material layers may be water-resistant or waterproof, but the assembled product is not represented as completely waterproof and does not guarantee that natural hair, braids, extensions, or other hairstyles will remain completely dry.

Product photographs, colors, hair appearance, texture, dimensions, packaging, and other visual details may appear somewhat different depending on lighting, screens, manufacturing variations, styling, or product updates. We make reasonable efforts to describe products accurately.

No product description, photograph, feature statement, water-resistance statement, heat-resistance statement, safety instruction, or adult-supervision requirement should be interpreted as a guarantee that injury, water entry, entanglement, or other hazards cannot occur. Product use always requires judgment appropriate to the child and the environment.

Safety and Proper Use

IMPORTANT SAFETY WARNING: ENTANGLEMENT AND STRANGULATION HAZARD. The Swim Hair Splash Cap includes long attached synthetic play hair and an adjustable drawstring. Long hair, cords, loops, or loose components can become caught, entangled, or wrapped around the neck, body, another person, drains, suction outlets, filters, pumps, ladders, playground equipment, moving machinery, or other objects. Serious injury or drowning may result if the product is used without appropriate precautions and active adult supervision.

The Swim Hair Splash Cap must be used only as intended, with active supervision by a responsible adult. A responsible adult should inspect, fit, adjust, and approve the product before each use and remain attentive while the child is wearing it.

  • Never leave a child unattended while wearing the Swim Hair Splash Cap, whether in or out of the water.
  • Keep the cap and all attached hair away from pool and spa drains, suction outlets, filters, pumps, water jets, ladders, moving equipment, machinery, escalators, playground equipment, bicycles, scooters, rides, doors, and other snag or entanglement points.
  • Do not intentionally place the attached hair into or near drains, suction devices, filters, pumps, jets, or moving equipment. Do not use the product if the hair could contact or be drawn toward a suction outlet.
  • Never wrap, tie, twist, knot, loop, or secure the attached hair or drawstring around a child's neck, chin, face, body, arms, legs, another person, or any object.
  • Never tie the drawstring under the chin or around the neck. Keep the drawstring and toggle close to the cap and do not permit loose cord ends or loops to dangle where they can snag.
  • Do not allow the attached hair to cover the child's eyes, nose, mouth, or face, or otherwise interfere with vision, breathing, hearing, swimming movement, or the ability to exit the water.
  • Before entering the water, confirm that the cap fits securely but comfortably. Do not use a cap that is excessively tight, excessively loose, slipping, damaged, torn, stretched out, or otherwise unable to remain safely positioned.
  • Inspect the cap, seams, stitching, hair attachment points, drawstring, and toggle before every use. Stop using the product immediately if any component becomes loose, detached, frayed, torn, damaged, or excessively worn. Keep detached or loose components away from children.
  • Do not allow children to chew, mouth, suck on, or intentionally pull on the drawstring, toggle, hair, stitching, or other components.
  • Remove the product immediately if the child experiences discomfort, pressure, skin irritation, restricted movement, obstructed vision, difficulty breathing, or any unsafe condition.
  • The Swim Hair Splash Cap is not a personal flotation device, life jacket, lifesaving device, rescue device, or substitute for swimming ability, water-safety practices, lifeguard instructions, or active adult supervision.
  • Follow all posted rules and instructions at pools, beaches, waterparks, hotels, resorts, splash pads, spas, and other recreational facilities. If a facility prohibits long hair, loose hair accessories, or similar items, do not use the product there.
  • Keep the product away from open flames, candles, stoves, grills, fireplaces, cigarettes, lighters, and other ignition sources. Heat resistance for styling does not mean the synthetic hair is flame resistant.
  • Do not sleep in the product or use it during any activity in which long attached hair could become trapped, caught, pulled, or entangled.

Hair Length and Adult Trimming

The attached play hair is approximately 30 inches long. Hair length should be appropriate for the individual child, the child's size and swimming ability, and the activity and environment in which the product will be used. If the hair is too long for the child to manage safely, interferes with movement or vision, or could contact drains, equipment, or other hazards, do not use the product at that length.

  • A responsible adult may shorten the synthetic hair before use if needed for safer fit and management.
  • Always remove the cap from the child before cutting. Place the product on a stable surface and use appropriate scissors away from the child.
  • Cut only the synthetic hair. Do not cut, puncture, or alter the cap body, seams, stitching, hair attachment points, drawstring, toggle, or other structural components.
  • After trimming, inspect the product carefully and remove loose fibers or strands before allowing a child to wear it.
  • Shortening the hair may reduce excess length but does not eliminate entanglement, strangulation, suction, or drowning risks. All other safety precautions and active adult supervision remain required.
  • Cutting or otherwise altering the hair is permanent and makes the product ineligible for the voluntary 30-Day Unworn Product Guarantee and change-of-mind return, except where applicable law provides a non-waivable remedy.

Heat Styling, Fire Safety and Product Alteration

The attached synthetic play hair is heat-resistant up to 325°F. The heat rating applies to the attached synthetic hair only and does not mean that the cap body, seams, drawstring, toggle, child's natural hair, skin, or any other component is safe for direct heat exposure.

  • Heat styling must be performed by a responsible adult only. Never use a heated styling tool on the product while it is being worn by a child.
  • Do not exceed 325°F. Use the lowest effective temperature and keep heated tools away from the cap body, seams, stitching, drawstring, toggle, and attachment points.
  • Never heat-style the product in or near water. Make sure the product is dry before heat styling and allow all styled hair to cool completely before placing the cap on a child.
  • Keep the product and heated styling tools away from the child's skin, face, scalp, eyes, and natural hair to prevent burns or other injury.
  • Heat resistance does not make the hair flame resistant. Keep the product away from open flame and ignition sources at all times.
  • Coloring, bleaching, chemically treating, washing, cutting, heat-styling, braiding, restyling, or otherwise altering the attached hair may change its appearance, texture, performance, durability, or safety and may make the product ineligible for a voluntary return.

Caregiver Responsibility and Assumption of Risk

Water activities involve inherent risks, including slips, falls, submersion, drowning, collision, and contact with drains or equipment. Long attached hair and adjustable components may create additional foreseeable risks of entanglement, snagging, wrapping, pulling, or obstruction if not properly managed. By purchasing or permitting a child to use the product, the responsible adult acknowledges these risks and agrees to use reasonable care, provide active supervision, follow all product instructions and facility rules, inspect the product before use, and discontinue use when conditions are unsafe.

The adult purchaser is responsible for communicating these safety instructions to any parent, guardian, babysitter, coach, caregiver, or other person who may supervise a child using the product. No person should permit use by a child when the adult cannot provide the level of supervision required by the child, the environment, or the activity.

This acknowledgment allocates responsibility only to the extent permitted by applicable law. It does not waive or limit any right, remedy, warranty, or liability that applicable law does not allow to be waived or limited, including any non-waivable rights relating to a defective product or legally protected consumer claim.

Safety Concerns and Incident Reporting

Stop using the product immediately if a safety concern, unexpected failure, injury, near-miss, loose component, stitching failure, drawstring problem, or other potentially hazardous condition occurs. Customers should report product-safety concerns promptly through the customer contact method on the official Swim Hair website and retain the product, packaging, order information, photographs, and other relevant information when reasonably possible so the concern can be evaluated.

Orders and Acceptance

An order confirmation acknowledges that an order was received and does not necessarily constitute final acceptance. Swim Hair LLC may cancel or limit an order when reasonably necessary because of inventory errors, pricing errors, payment problems, suspected fraud, unauthorized resale activity, shipping restrictions, or other legitimate business reasons. If we cancel an order after payment has been collected, the applicable amount will be refunded.

Pricing, Promotions and Discount Codes

Prices and promotions may change without notice. Promotional offers, bundles, coupons, free-item offers, and discount codes may be subject to separate conditions, expiration dates, quantity limits, exclusions, and availability. Unless expressly permitted, promotions cannot be combined. If a qualifying bundle or promotional order is returned, the refund may be adjusted to reflect the value of products retained by the customer, to the extent permitted by law and disclosed by the applicable promotion.

Taxes

Applicable sales, use, or similar taxes may be charged based on the order and shipping destination as required by law.

Shipping and Delivery

Shipping and delivery dates are estimates unless expressly guaranteed. Customers are responsible for providing a complete and accurate delivery address. Carrier delays, weather, emergencies, incorrect addresses supplied by customers, and other circumstances outside our reasonable control may affect delivery.

A package marked delivered by the carrier should be promptly checked at the delivery location and with household members or building personnel. Customers should contact Swim Hair LLC promptly regarding a suspected lost, missing, or misdelivered order so available carrier or shipping procedures can be reviewed.

Resale

Products purchased through the consumer website are intended for personal use unless Swim Hair LLC has approved a wholesale, retail, distribution, or other resale arrangement. Swim Hair LLC may limit quantities or reject orders reasonably believed to be placed for unauthorized commercial resale.

Website Content and Intellectual Property

Swim Hair LLC owns or licenses the website content and brand materials, including the Swim Hair name, Swim Hair Splash Cap name, logos, product imagery, photographs, videos, graphics, written content, advertising materials, product presentation, and other protected materials. No content may be copied, reproduced, republished, distributed, modified, exploited, or commercially used without authorization except as permitted by law.

User Reviews and Submitted Content

If you voluntarily submit a product review, photograph, testimonial, comment, or other content through a feature that states it may be published, you represent that you have the right to submit that material. Swim Hair LLC may display, moderate, or remove submitted content consistent with the terms presented with the submission and applicable law. Do not submit another person's private information or content that you do not have permission to share.

Prohibited Website Use

  • Do not use the website for unlawful, fraudulent, abusive, or deceptive activity.
  • Do not attempt to interfere with website security, payment processing, accounts, or technical systems.
  • Do not use automated methods to scrape, copy, or commercially exploit protected website content without authorization.
  • Do not impersonate another person or provide false payment, identity, or transaction information.

Third-Party Services and Links

The website may use or link to third-party platforms, payment processors, social networks, shipping providers, or other services. Swim Hair LLC does not control third-party services, and use of those services may be governed by separate terms and privacy policies.

Disclaimer and Limitation of Liability
